US Court Orders Release of Kilmar Abrego Garcia from ICE Detention

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.

The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. After his return to the United States to answer alien smuggling allegations, he was held in federal custody.

In her decision, the judge noted that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The legal proceedings involve disputed claims. Whereas the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this allegation.
